UP RERA to penalise builders for delaying possession

The Uttar Pradesh Real Estate Regulatory Authority (UP RERA) has sent 250 matters relating to possession of the allottees to the courts of adjudicating officers at RERA headquarters and NCR office.

The chairman has taken strong objection to the promoter’s not providing possession to the allottees even after the orders of RERA. Under the present orders of UP RERA, l the adjudicating officers will ensure delivery of possession to the allottees, heavy penalty will also be imposed upon such promoters for willful disobedience of the orders of RERA.

Now the adjudicating officers will ensure the registered sale deeds and possessions as per the provisions of Rule-24 of UP RERA Rules, 2018. The adjudicating officers have the powers of C.P.C. (Code of Civil Procedure) under Rule-24 which they will use for expediting the delivery of possession and execution of the sale deeds.

They have also the powers to attach the units and appoint the receivers for the purposes of enforcement of these orders. The adjudicating officers will be responsible for effective time bound proceedings to ensure the sale deeds and delivery of possessions.

“UP RERA is not ready to accept any kind of delay by the promoters in complying with the orders of RERA and thus forcing the allottees to run from pillar to post. The RERA has been enacted to protect the interests of allottees and RERA will see to it that its orders are complied by the promoter in time,” said Sanjay Bhoosreddy, chairman, UP RERA.
