House owners have been advised to restore unauthorised S+4 buildings to their original position and not sell or purchase units on the fourth floor.
The District Town Planner of Gurgaon recently issued a notice stating that legal action would be taken against all stilt-plus-four-floor (S+4) buildings constructed after a February 23, 2023 ban order. The notice will also impact buildings for which occupation certificates were issued without the approval of the building plan before the order.
The order said immediate action would be taken to restore such construction to its original position. All architects who violated the Haryana government orders would be blacklisted, and the council of architecture would be requested to take penal action against all such architects under intimation to the department, the notice said.
The state government decided to impose a ban on the approval and construction of S+4 floors on residential plots on February 23, 2023. However, even after the ban, occupation certificates were issued by some architects where building plans for the fourth floor were not approved before it, the notice said.
The director of Town and Country Planning, Haryana, issued directions on May 3, 2024, and it was observed that granting an occupation certificate for the fourth floor without prior approval of the building plan before the orders on February 23, 2023, is against the ban on imposed by the state government, the notice said.

The notice said any breach in implementing the order would invite immediate revocation/cancellation of the occupation certificate and disciplinary action against the defaulting owner/architect/all stakeholders.
